Nightlife Entertainment, LLC has no control over your event other than the ability to provide the disc jockey and/or karaoke services that you are requesting, Nightlife Entertainment, LLC disclaims any liability with regard to the success of your event other than pursuant to the terms of your contract with it. The money back guarantee set forth above constitutes the only guarantee, warranty or representation that Nightlife Entertainment, LLC makes to you. In particular, but without limitation, Nightlife Entertainment, LLC does not warrant the product or services of third parties or activities beyond its control. Except for the warranty that Nightlife Entertainment, LLC will honor its money back guarantee set forth above, Nightlife Entertainment, LLC makes, and you receive no warranties, express, implied, statutory, or otherwise, and Nightlife Entertainment, LLC specifically disclaims any implied warranty of merchantability or fitness for a particular purpose. By entering into a contract with Nightlife Entertainment, LLC, you acknowledge and agree that you are receiving no warranty or other rights from or with respect to Nightlife Entertainment, LLC’s provision of services under your contract with it other than the money back guarantee set forth above. You agree that you will indemnify Nightlife Entertainment, LLC and its members, officers, employees and independent contractors against and hold same harmless from and against any and all claims, actions, suits, proceedings, costs, expenses, damages and liabilities ( including actual attorneys fees and costs ) claimed by any person, organization or association arising out of or related to your contract with Nightlife Entertainment, LLC.

Except as expressly stated herein, Nightlife Entertainment, LLC shall have no responsibility for, nor shall you make any claim against Nightlife Entertainment, LLC except under the money back guarantee above stated, for any loss or damage relating to or arising out of Nightlife Entertainment, LLC’s provision of services hereunder, whether in contract or in tort or based upon any other legal theory whatsoever, including, without limitation, any claim based on errors or interruptions in service that are not fully the fault of Nightlife Entertainment, LLC, any claim for special, incidental or consequential damage or injury to persons or property, or any claim for indemnification of a third party against you. YOU HEREBY WAIVE ALL SUCH CLAIMS, INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.

The contract between you and Nightlife Entertainment, LLC shall be governed by the internal laws of the State of Wisconsin. In the event of a dispute relating to said contract or any services provided by Nightlife Entertainment, LLC, you agree that any proceedings that you institute to resolve such dispute or to seek relief against Nightlife Entertainment, LLC based upon any theory of recovery whatsoever shall have as its forum, and any proceedings instituted by Nightlife Entertainment, LLC may, at Nightlife Entertainment, LLC option, have as its forum, a court of general jurisdiction situated in Milwaukee County, Wisconsin. You hereby consent to the jurisdiction and venue of any such court and waive any objection based on improper or inconvenient jurisdiction or venue.
